Overview
These Terms of Service (“Terms”) govern your use of the website operated by Galaxium at https://www.galaxiumglasses.com (the “Site”) and any purchases you make through the Site. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or purchase products from us.
Our online store is hosted by Shopify Inc. Shopify provides the ecommerce platform that allows us to sell products and services to you. Your use of Shopify-hosted checkout may also be subject to Shopify’s applicable terms, policies, and practices.
Updates
We may update these Terms from time to time. The updated version will be indicated by an updated “Last updated” date (or similar) where we publish the Terms on the Site, unless a different notice approach is required by law. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.
Eligibility
You represent that you are at least the age of majority in your place of residence, or you have obtained verifiable consent from a parent or legal guardian, and that you have the legal right and capacity to enter into these Terms.
Products, packaging, and availability
We sell solar eclipse viewing products and related items as described on the Site. Product images, descriptions, specifications, certifications, and marketing materials are provided for information. We try to keep them accurate, but minor variations can occur between what you see on screen and what you receive (for example color, finish, or minor packaging updates). If something material is incorrect, contact us and we will work with you in line with our policies and applicable law.
Unless otherwise stated on the product page, our glasses are sold in fixed pack sizes (for example 6, 12, 25, 50, and 100 units per pack). The applicable pack size is the one you select at checkout.
We may limit quantities, refuse orders, or cancel orders where we reasonably believe the order is fraudulent, mistaken, or not permitted (including export or resale restrictions where they apply).
Solar viewing safety and proper use
Our products are intended for safe solar viewing only when used exactly as directed on the product labeling, inserts, and any instructions we provide. Solar viewing involves serious risk of permanent eye injury or blindness if products are misused, damaged, counterfeit, expired outside the manufacturer’s guidance, modified, or used with optical devices (such as cameras, telescopes, or binoculars) unless explicitly permitted by the manufacturer’s instructions for that exact configuration.
You are responsible for reading and following all warnings and instructions. Do not use damaged products. Children must be supervised by a responsible adult. If you are unsure whether a product is appropriate for your situation, do not use it for solar viewing and seek guidance from qualified eye safety resources or professionals.
Where we reference standards such as ISO 12312-2, that reference is informational and does not replace the manufacturer’s labeling, conformity markings, and usage requirements. Compliance depends on correct product, correct use, and correct storage and handling.
Orders, pricing, and payment
Product prices, fees, taxes, shipping estimates, and promotions are shown at checkout where applicable. We may correct pricing errors before acceptance of an order. Taxes and duties depend on shipping destination and local rules.
When you place an order, you offer to purchase the items in your cart subject to these Terms. We accept your order when we confirm it (for example via an order confirmation email or other confirmation method). Until then, we may decline or cancel the order.
Payment processing is handled by our payment providers. You authorize us and our providers to charge your selected payment method for the total shown at checkout, including applicable taxes and shipping where charged.
Fulfillment and shipping
Shipping timelines are estimates and are not guaranteed unless we expressly state otherwise. Risk of loss and title for physical products pass in accordance with the shipping terms presented at checkout and applicable law.
We may fulfill orders using inventory stored at Amazon fulfillment centers. Your package may ship via Amazon’s fulfillment network even though your purchase is completed on our store.
Returns, refunds, and exchanges
Our return and refund rules are described in our Return policy on the Site. That policy is part of your purchase understanding and may include restrictions tied to eclipse campaign windows, complete unopened packs, and wrapper integrity. If there is a conflict between a short summary on a product page and the full Return policy, the full Return policy controls unless applicable law requires otherwise.
Prohibited uses
You agree not to use the Site in any way that violates law, infringes rights, introduces malware, attempts unauthorized access, scrapes the Site in a manner that harms our systems, interferes with other users, or circumvents security or purchasing limits. We may suspend or terminate access for violations.
Intellectual property
The Site and its content (including text, graphics, logos, images, videos, and software) are owned by Galaxium or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial shopping purposes. No rights are granted except as expressly stated.
User content
If you submit reviews, questions, or other content to us or through the Site, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute that content for operating, promoting, and improving our business, subject to our Privacy policy and applicable law. You represent you have the rights to grant that license and that your content is lawful and not misleading.
Third-party services
The Site may link to third-party websites or services. We are not responsible for third-party content, terms, or practices. Your use of third-party services is at your own risk.
Disclaimer of warranties
To the fullest extent permitted by applicable law, the Site and products are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by applicable law, Galaxium and our directors, employees, contractors, and fulfillment partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, goodwill, or data, arising out of or related to these Terms, the Site, or products, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our aggregate liability for any claim arising out of or related to these Terms, the Site, or products will not exceed the greater of (a) the amount you paid to us for the product or order giving rise to the claim, or (b) one hundred British pounds (£100), except where applicable law does not permit such a cap (for example certain consumer rights).
Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence where applicable law forbids limitation, or liability for fraud or fraudulent misrepresentation.
Indemnity
You agree to defend, indemnify, and hold harmless Galaxium and our affiliates, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of products, your violation of these Terms, or your violation of any third-party rights, except to the extent caused by our willful misconduct or gross negligence where applicable law says otherwise.
Disputes and governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules that would require applying another jurisdiction’s laws, except where mandatory consumer protection laws of your country of residence require otherwise.
If you are a consumer resident in the United Kingdom or the European Union, you may also have mandatory rights under local consumer law, including access to courts where you live in some circumstances.
Severability and assignment
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign these Terms without our consent.
